5. And be it enacted, That in case either of the said trustees shall
die, or refuse to act, then it shall and may be lawful for the or-
phans court of Montgomery county, upon the application of the
parties interested, to appoint a trustee or trustees in place of such
person or persons so dying or refusing to act, who, before he or
they shall act as trustee, shall execute a bond to be approved at a-
foresaid, and recorded) and may be sued on as aforesaid.

CHAPTER 216.
An act to increase the pay of the Judges of the Orphans
Court for the several Counties therein mentioned.
Sec. 1. He it enacted by the General Assembly of Maryland, That
from and alter the passage of this act, each judge of the orphans
court of Prince-George's, Charles, St. Mary's, Cecil, and Somerset
counties, be and he is hereby entitled to receive, in lieu of his pre-
sent per diem, the sum of four dollars for every days attendance.

CHAPTER 217.
An act for the relief of Elizabeth Hutton of Baltimore
County.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
Elizabeth Hutton, of Baltimore county, be and she is hereby di-
vorced from bed, board, and mutual cohabitation with her husband
Levi Hutton.
2. And be it enacted, That all the right and title which the said
Levi Hutton by virtue of his marriage with the said Eliza-
beth Hutton had acquired to any property which she now is or
may become entitled to, in any way or manner whatsoever, be and
the same is hereby annulled and made void, and that the said Eli-
zabeth be and she is hereby declared capable to have, hold, take,
receive, sue for and recover, by compromise, suit or suits in law
or equity, all such property, in as full and ample a manner as if
she were a feme sole, and had never been married, and to hold,
use. and enjoy the same, for her own use and benefit, and the same
to dispose of according to her will and pleasure, without the mo-
lestation, interference, hindrance or consent, of her said husband,
in the same manner she could or might have done were she a feme
sole, and had never been married.

CHAPTER 218.
An act for the relief of sundry Poor Out-Pensioners of
Anne-Arundel County.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
the levy court of Anne Arundel county be and they are hereby au-
thorised and empowered, at their annual meeting, so long as they
may see cause so to do, to assess and levy on the assessable pro-
perty of said county, for the use of William Cocklin and Eliza-
beth White, the sum of thirty dollars each; to Elizabeth Hatwell,
in addition to the sum allowed her, the sum of ten dollars; to Mo-
ses Deavor the sum of thirty dollars, for the use of his afflicted
daughter; which said sums of money, when collected, shall be paid
over annually by the collector of Anne-Arundel county to the
above named persons, or their orders.
