Allowance
Obstructions.

before he proceeds to act, give bond to the aforesaid commission-
ers, with two sufficient securities, in the sum of one thousand dol-
lars, that he will faithfully perform the duties required of him by
this act.
3. And be it enacted, That the assessor shall be allowed by the
aforesaid commissioners a sum not exceeding fifty dollars, and to
the collector a sum not exceeding eight per centum on the monies
by him collected.
4. And be it enacted, That any person or persons who shall at any
time place, or cause to be placed, any thing which may obstruct
the free passage of the roads, streets, alleys, lanes or footways, as
laid down in said town by the aforesaid commissioners, and shall
refuse or neglect to remove the same after public notice has been
given for twenty clays by the aforesaid commissioners, shall forfeit
the sum of one hundred dollars for every twenty days said obstruc-
tion or obstructions shall remain after said notice shall have
been given, to be recovered by the aforesaid commissioners on ap-
plication to any justice of the peace in the county the offender or
offenders may reside, and the aforesaid commissioners are hereby
authorised and empowered to remove any obstruction or obstruc-
tions, if any at present exist, in the roads, streets, alleys, lanes or
foot-ways, in said town.

To have her
dower in land

CHAPTER 204.

An act for the benefit of Mary Mackubbin, of Anne-Arun-
del County
Whereas, it is represented to this general assembly, by the pe-
tition of Mary Mackubbin, that she some time since intermarried
with a certain Frederick Mackubbin of the county aforesaid, who
in his lifetime purchased of the heirs at law of the late Col. James
Brice, a tract or parcel of land lying on Severn river in said coun-
ty, containing about the quantity of five hundred acres, to which
he obtained no legal title, in consequence whereof she the said
Mary is not entitled to dower therein, although the whole of the
purchase money has been paid by sales of property held by your
petitioner, prior to her said intermarriage: And whereas, James
Mackubbin, the father of the said Frederick Mackubbin, and guar-
dian of the infant children of the said Frederick and Mary Mac-
kubbin, have petitioned the chancery court for an allowance of her
dower in the equitable estate of the said Frederick in the said
land, which the court could not grant, as well by reason of the ir-
regularity of the proceedings, as on account of the nature of the
estate, as appears by the proceedings exhibited with the petition
of the said Mary, Therefore,
Sec. 1. Be it enacted by the General Assembly of Maryland, That
the said Mary Mackubbin shall be entitled to, and have her dower
in said land, laid off and assigned to her, in the same manner as if
her husband had died seized in fee simple of the came, any law to
the contrary notwithstanding.
