all the real estate of Benjamin Deford late of said county de-
ceased, and upon the payment of the whole purchase money,
he convey the same to the purchaser or purchasers thereof,
which conveyance being duly made, shall be sufficient to con
vey all the right, title, claim and interest of in and to the said
real estate, that the said Benjamin Deford had therein at the
time of his death, and that the said trustee distribute the pro-
ceeds among the heirs of the said deceased, under the direction
of the chancellor of this state, in such proportions as the law
directs in cases of intestacy.
2. AND BE IT ENACTED, That the said Richard G.
Hutton before he proceeds to exercise any of the powers vest-
ed in him under the provisions of this act, shall give bond and
security to the State of Maryland, in such penalty and with
such security as the chancellor aforesaid shall direct, for the
faithful performance of all and singular the powers by this act
vested in him, and that the said bond be recorded by the regis-
ter in chancery, which bond or on office copy thereof may be
put in suit by any person or persons interested in the perform-
ance of the condition of the same; Provided always, and be it
enacted, that no sale made by the trustee aforesaid, of the said
Benjamin Deford's real estate in virtue of this act shall be
good and valid until the same be approved of by the chancellor
aforesaid, and in case any such sale shall be rejected by the
chancellor, the said trustee shall proceed to sell again, and so
on from time to time, until such sale be approved of by the

chancellor.
3. AND BE IT ENACTED, That the said trustee shall
be entitled to such sum or sums of money for his expences
and trouble that he may be necessary put to in performing the
duties required by this act as the chancellor may think proper
to allow him.

CHAPTER 81.

An act to authorise the sale of the real estate of William Ham-
mond deceased.
Sec. I. BE IT ENACTED by the General Assembly of
Maryland, That it shall and may be lawful for the chancellor

of this state, upon petition of all or any of the parties interest-
ed, to appoint one or more persons as he shall think proper, to
sell and dispose of all the lands of which William Hammond, of
Anne Arundel county died possessed, on such terms and in
such quantities as to him may appear most for the benefit of
the heirs and representatives of the said deceased, and to autho-
rise the trustee or trustees so appointed, on the confirmation of
the sale or sales by the chancellor, and the receipt of the pur-
chase money, to make and execute a deed or deeds of convey-
ance for the said lands, or any part thereof to the purchaser or
purchasers thereof; and the said trustee or trustees are hereby
authorised and directed to pay into the court of chancery, the
proceeds of such sale or sales, to be applied, after the payment
of the expences of such sale or sales, and such commission to
said trustee or trustees as the chancellor may think reasonable,
to the payment of all just claims against said deceased, and the
residue to be distributed among the devisees of the said Wil-
liam Hammond, agreeably to the provisions of his last will and
testament; which claims and proportions shall be liquidated by
the auditor of said court under the direction of the chancellor.
