lodged and re-
corded.

Vacancies.

or disposal of any ticket or tickets in said lottery give their
bond to the State of Maryland, in the penalty of twenty thou-
sand dollars, conditioned that they will well and truly apply
so much money arising therefrom within twelve months after
the drawing of said lottery shall commence, as will satisfy the
fortunate adventurers for prizes drawn by them, and after de-
ducting the expences incurred in said lottery, shall within two
years from the time of the drawing said lottery shall commence,
apply the money raised by said lottery for the purpose of build-
ing the bridge aforesaid.
2. AND BE IT ENACTED, That it shall be the duty of
said commissioners or a majority of them, before they act as
such, to lodge the bond made and entered into as aforesaid, in
the office of the clerk of Saint Mary's county court, there to
be recorded, and upon such bond or any office copy thereof suit
or suits may be instituted against the obligors therein mention-
ed, or any one of them, or their legal representatives for any
breach or non-compliance with the conditions of the same.
3. AND BE IT ENACTED, That in ease any vacancy or
vacancies shall occur by the death, resignation, removal or re-
fusal to serve of any of said commissioners, then and in that
case it shall and may be lawful for the said board to make
choice of any person or persons to fill said vacancy or vacan-
cies.

CHAPTER 104.
An act for the benefit of Ignatius Pike of Saint Mary's County.
WHEREAS, It is represented to this General Assembly by
the petition of Ignatius Pike, of Saint Mary's county, that in
the year eighteen hundred and ten, two hogsheads of tobacco
were inspected at Calhoun's warehouse in the city of Baltimore,
and deposited therein by a certain Joseph Greenwell, who ob-
tained tobacco notes for the same, which said notes were paid
over to said petitioner by said Joseph Greenwell, that in the
year eighteen hundred and thirteen when performing a tour of
militia duty, said petitioner lost said tobacco notes, and had it
not in his power to comply with the provisions of law in time
to enable him to obtain new tobacco notes for said tobacco from
the inspector of said warehouse; Therefore,
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That if the said Ignatius Pike shall make oath be-
fore a justice of the peace of Baltimore county, at any time
within six months after the passage of this act, to the marks,
numbers and dates of such notes that the same were made to
Joseph Greenwell and by him paid over to the said Ignatius
Pike, and for what quantity of tobacco the same were given,
and that he at the time said notes were lost mislaid or destroy-
ed was lawfully and justly entitled to receive the tobacco men-
tioned in said notes, and shall take a certificate thereof from
such justice, and upon producing such certificate to the inspec-
tor or inspectors for the time being at Calhoun's warehouse, and
lodging the same with him or them, the said inspector or in-
spectors shall deliver to the said Ignatius Pike, new notes for
the said two hogsheads of tobacco, with the marks, numbers,
weights and dates corresponding with the former notes so lost,
mislaid or destroyed, or for either of them that shall be remain-
ing in said ware house at the time of the application and pro-
