road is opened and cleared, agreeably to the directions
of this act.
4. AND BE IT ENACTED, That the said commis-
sioners, before they proceed to act, shall take an oath
before some justice of the peace, that they will, with-
out favor, partiality or prejudice, asses the damages
sustained by the persons through whose land the said
road may pass, by reason of opening the same.

5. AND BE IT ENACTED, That the said commis-
sioners, shall be entitled to receive a compensation fur
their attendance and services, in discharge of their du-
ties of this act, not exceeding two dollars per day, to be
ascertained by the levy court, which is hereby direct-
ed to be levied, collected and paid, as other county char-
ges are levied, collected and paid.

CHAPTER 47.

An act for the benefit of the widow and heirs of William
Holland of Montgomery county.
WHEREAS it has been represented to this general
assembly by the petition of Catherine Holland, widow of
William Holland, deceased, that the said William died
intestate, possessed of some real and personal property,
leaving nine children all minors. And whereas it is re-
presented that the interest of the said minors would be
greatly promoted by the sale of a part of the real estate
for the creditors; Therefore,

Preamble.

SEC. 1. BE IT ENACTED by the General Assem-
bly of Maryland, That the orphans' court of Montgo-
mery county shall have full power and authority, on the
petition of the said Catharine Holland, (Provided, the
court shall be satisfied that it will conduce to the interest
of the said monies) to order the sale of any part of the
said real estate upon such terms and upon such conditions
as the court may think proper, and to appoint a trustee
for the purpose of effecting such sale, which said trustee
before he proceeds to act by virtue of this appointment,
shall give bond to the state of Maryland in such penalty,
and with such security as shall be prescribed and appro-
ved of by the said court for the faithful performance of
the trust reposed in him.

2. AND BE IT ENACTED, That the said bond,
shall be filed, and recorded in the office of the register of
wills of Montgomery county, a copy whereof under the
seal of the orphans' court of the said county shall be re-
ceived in evidence in any court of law or equity in this
state.

3. AND BE IT ENACTED, That any conveyance
or deed made by the trustee aforesaid shall be, and the
same is hereby declared to be valid and effectual to pass
and convey all the right, title and interest of the said mi-
nors in and to any tract of land and real estate aforesaid,
to the purchaser or purchasers of the same.
