Application of
the money.

8. AND BE IT ENACTED, That the money au-
thorised to be raised by the lottery aforesaid, shall be
applied under the direction of the mayor and city council
aforesaid to the purposes directed by this act in such
manner as they may consider most judicious and use-
ful.

Preamble.

CHAPTER 117.

An act authorising Zephaniah Waters of Charles coun-
ty, to raise by lottery, a sum of money for the purpose
therein mentioned.
WHEREAS, Zephaniah Waters of Charles coun-
ty, hath set forth by his petition to this General As
sembly, that great advantages Would result to the inhab-
itants of that section of the state where he resides, from
the erection of a fulling mill with a carding and spin-
ning machinery thereto annexed,and hath prayed that an
act may pass authorising him to raise by lottery a certain
sum of money for the purpose aforesaid; Therefore,

Sec. 1. BE IT ENACTED by the General Assem-
bly of Maryland, That it shall and may be lawful for Al-
exander Johnson, Joseph Simpson, Joseph ,A. Turner,
James Boarman and Zephaniah Waters, or a majority
of them, to propose a scheme or schemes of a lottery to
raise a sum of money not exceeding two thousand dol-

lars, and to sell and dispose of the tickets thereof; Pro-
vided the said Alexander Johnson, Joseph Simpson, Jo-
seph A Turner, James Boarman and Zephaniah Waters,
or such majority of them as shall undertake to act, before
the sale or disposal of any ticket or tickets in said lot-
tery, shall give bond to the state of Maryland in the pen-
alty of ten thousand dollars, conditioned that they will
well and truly apply so much of the money arising
therefrom, within six months after the competition of
drawing said lottery, as will satisfy the fortunate ad-
venturers for prizes drawn by them; and after deducting
the necessary expenses incurred, in said lottery, shall
within eighteen months after the drawing of said lottery
is completed, cause the said money to be laid out in the
erection of a fulling mill with a carding and spinning
machinery thereto annexed, in Charles county, at a
place to be procured and fixed on by the said Zepha-
niah Waters, with the approbation of the commission-
ers aforesaid, and for the benefit and advantage, and as
the property and estate thereafter, of the said Zephani-
ah Waters, his heirs and assigns.

Sum not being
sufficient.

2. AND BE IT ENACTED, That in case the sum
of money to be raised by the provisions of this act shall
not be sufficient for the purpose of erecting and comple-
ting the fulling mill and machinery aforesaid, then it
shall be the duty of the said commissioners or a majority
of them as aforesaid, to apply the same to erecting and
completing the said mill so far as the same may suffice.
