ed in him.
2. AND BE IT ENACTED, That the said bond shall
be filed and recorded in the office of the register of wills
of Frederick county, a copy whereof under the seal of the
orphans court of said county shall be received as evi-
dence in any court of law or equity in this state.
3. AND BE IT ENACTED, "That any conveyance
shall or deed made by the trustee aforesaid, shall be, and the
same is hereby declared to be valid and effectual to
pass and convey all the right, title and interest which
was in the said Joseph Ogle, in and to the lands afore-
said, to the purchaser or purchasers of the same.

4. AND BE IT ENACTED, That the said orphans
court shall direct the trustee to give notice of the time
and place appointed for the sale of the said lands, by
advertisement set up in the most public places and some
news paper or papers at least three weeks before the
sale, and the said court shall direct the said lands to be
sold on such credit as to them shall seem proper.

5. AND BE IT ENACTED, That the money arising
from the sale of the said lands, after deducting the ex-
penses of the sale of the same, to be ascertained by the
orphans court aforesaid, shall be paid over, under the
direction of said court, to the heirs and devisees of the
said Joseph Ogle.

Bond may be
put in suit.
|
6. AND BE IT ENACTED, That if the trustee
aforesaid shall neglect or refuse to pay to the heirs or
devisees of the said Joseph Ogle, the sums ascertained
to be due to them respectively, his bond aforesaid may
be put in suit by the heirs or devisees whom he may neg-
left or refuse to pay, upon which suit such heir or de-
visiee shall recover the sum ascertained to be due, by the
said register, with interest and costs of suit.

CHAPTER 125.
An act to authorise the raising of a sum of money by a
lottery or lotteries, to build an arsenal for the City of
Baltimore, and for other purposes.
Section 1. BE IT ENACTED by the General As-
sembly of Maryland, That John Stricker, James Cal-
houn, George P. Stevenson, Joseph Sterrett, Standish
Barry, Richard Key Heath, James Cheston, William
M'Donald, Thomas Tenant. William Pechin, Joseph
Biays, junr. Kenedy Long, Samuel Moore, James L.
Donaldson, Benjamin Fowler, Jacob Steiger, James
Biays, William Jackson, William B. Barney, Lemuel
Taylor, David Harris, Joseph Jamieson, Solomon G.
Albers, Upton S. Heath, Henry Amry, John Young,
John Matthews and Thomas Sweeting, or a majority of
them be, and they are hereby appointed commissioners to
propose a scheme or schemes of a lottery or lotteries for
