ceding the election, be authorised to elect, on the first Monday of
April, in the year eighteen hundred and twenty-five; and on the
same day, annually, for ever thereafter; the Burgess and six com-
missioners for the said town, who shall be inhabitants thereof,
above twenty-five years of age, and holding real property in the said
town; the election to be held at the most central part of said town;
and the polls to be kept open from nine o'clock in the morning, un-
til two in the afternoon.

Sec. 4. And be it enacted, That a justice of the peace, for the
time being, residing in or near Emmittsburg, shall appoint by
writing, under his hand and seal, one judge to hold the first elec-
tion for Burgess and commissioners; and the said judge shall
conduct the said election in the manner in which the judges of an
election district are now directed by law to hold an election for dele-
egates to the General Assembly, as far as may be consistent with the
other provisions of this act; and the said judge shall make return,
under his hand and seal, of the persons elected as the burgess
and commissioners, to the clerk of Frederick county to be by
him safely kept; all future elections to he held by one or more judg-
es, in such manner as shall be directed from time to time by or-
dinance of the corporation; the same not being inconsistent with
this law.

Sec. 4. And be it enacted, That the said commissioners shall have
full power and authority to enact and pass all laws and ordinan-
ces to preserve the health of the town; prevent and remove nui-
sances; to regulate fire companies; to impose and appropriate fines,
penalties and forfeitures, for the breach of their by-laws or ordi-
nances; to lay and collect taxes for opening and extending the
back and necessary cross alleys of the said town; provided that the
said taxes shall not exceed twenty cents on every hundred dollars
worth of taxable property in any one year, which they may collect
as county taxes are collected, by such persons as the burgess may
see fit to appoint. All ordinances and by-laws, to be signed by the
burgess.

Sec. 5. And be it enacted, That the said commissioners, or a
majority of them, shall have power to appoint their own clerk, and
assign to him his duties; and also to allow him a salary in their
discretion.

Sec. 6. And be it enacted, That all ordinances passed by the
said commissioners shall, by their clerk, be entered in a book, to
be kept by him for that purpose; and shall be open at all times, for
the inspection of any person; and copies of said ordinances shall
be put up in the most public places of said town, that the same
may be generally made known.

Sec. 7. And be it enacted, That all fines and forfeitures under
the ordinances of the said corporation, shall be recovered before
the burgess aforesaid, in like manner, as small debts are recover-
ed out of court.

Sec. 8. And be it enacted, That the said commissioners shall
meet upon the business of the town, at least three times in every
year; and four commissioners shall make a quorum for the transac-
tion of business; and if during the year for which they are elected,
any of the six commissioners should die, reign, remove from the
