CHAP. 137.

through the lands of Marcus S. Waring and Henry Compton, in
Matapony hundred; which said commissioners, so appointed by
the levy court aforesaid, are hereby directed to make a fair plot
and certificate of said alterations, and return the same to the
levy court aforesaid, there to be recorded, which said alteration,
when so made and adopted by the levy court aforesaid, shall be a
public highway in lieu of the part discontinued, and be kept in
repair as other highways are, and that the expenses attending the
same he levied in the county tax of said county.

2. And be it enacted, That the public road commencing at a
place known by the name of White's Hill, and running through
the lands of James Richardson, W. Cage, and part of the
lands of the late General Covington. now occupied by Rich-
ard T. Hall, to Cary's Hill, be and the same, is hereby discon-
tinued as a public highway, any law to the contrary notwith-
standing.

CHAP CXXXVIII.

An Act for the relief or the Library Company of Baltimore.

WHEREAS the Library Company of Baltimore have, by their
petition set forth, that they are possessed of a lot of ground si-
tuate at the intersection of Calvert and Church streets in the city
of Baltimore, which a number of persons heretofore entered into
an agreement to purchase, for the purpose of erecting thereon a
building for the accommodation of the said company; that a part
only of the purchase money hath been paid, and the parties to
said agreement have declined the further prosecution of their plan;
that the said company are desirous of procuring a sale of said
lot of ground in order to satisfy the balance of purchase money
yet due thereon, but cannot, owing to the number of persons that
are necessary to be made defendants, obtain redress by the or-
dinary course, of law, within any reasonable period, and there-
fore, pray that a special law may pass to authorise said sale, and
the prayer of said petitioners being thought reasonable, There-
fore.

1. Be it enacted by the General Assembly of Maryland, That
John Spear Smith, Esquire, of the city of Baltimore, shall be and
hereby is appointed trustee, with full power and authority to sell
the said lot and premises in the preamble mentioned, at public
auction, in the city of Baltimore, at such time and place, and on
such credit and terms, as in his judgment will be most beneficial
to all persons interested in the same, and as soon thereafter as
may be convenient, he shall report said sales, under oath, to the
judges of Baltimore county court, as a court of equity, for their
ratification, as in cases where sales are made under authority of
said court, and on receipt of the purchase money, and ratification
of said sales, and not before, the said trustee shall make a good
and sufficient conveyance of the Library Company's title therein
to the. purchaser or purchasers, as the case may be, and the said
purchaser or purchasers shall hold the same, free and discharged
from all claims on the part of the Library Company, as well as
of all and every person who may have signed a scheme for pay-
ing for said lot and erecting buildings thereon, dated on the 29th
day of February eighteen hundred and sixteen, and of those
claiming under them or any of them.
