CHAP. 130.

Proviso.

pensaries, attested by the secretary of those institutions, shall be
sufficient evidence of the right of the person therein named to be
deemed a contributor to the Baltimore General Dispensaries, for
the time in such certificate mentioned; Provided always, that it
shall be the duty of any person, claiming exemption under this
act, to produce to the captain or commanding officer of the dis-
trict where he resides, such proof of his conscientious scruples,
as is required by the first section of the act, entitled, An act to
regulate and discipline the militia of this state, passed at Novem-
ber session eighteen hundred and eleven.

Preamble.

CHAP. CXXXI.

11 A Further Additional Supplement to an act, entitled, An act to Incorporate a
Company for erecting a Bridge over Chester River, at Chester Town.

WHEREAS it is represented to this general assembly, that in
the year eighteen hundred and four, a law was passed authoris-
ing the erection of a bridge over Chester river at Chester Town,
and directing that the draw of said bridge should not be less than
twenty feet wide, and by sundry supplements to said act the
managers named in the said supplements were authorised to draw
a lottery to aid in erecting the said bridge, and that the contract
for erecting the said bridge was actually entered into on or about
the fourth day of December eighteen hundred and nineteen,
whereby the draw of said bridge was agreed to be made thirty
feet wide; and it further appears, that after the said contract was
entered into, a supplement to the said law was passed, directing
that the said draw should be made thirty-five feet wide, which
provision the funds of the company did not enable them to com-
ply with, and it is deemed proper that the said draw should be
widened, without interfering with the existing contract of the
company; and for the purpose of enabling the said company to
widen the said draw, the legislature is willing to release the five
per cent tax; Therefore,

from payment of
tax.

Provisos.

1. Be it enacted by the General Assembly of Maryland, That
the lottery heretofore authorised to be drawn to aid in erecting
the said bridge, be and the same is hereby released and relieved
from the payment of the tax of five per centum; Provided, that
the managers named in the last mentioned supplement, or the
president and directors of the said company for the time being,
do and shall execute a bond to the state of Maryland, to be filed
in the office of the clerk of Kent county court, before they com-
mence drawing said lottery, in the penal sum of ten thousand
dollars, conditioned that the said draw shall be made forty feet
wide within twelve months after the completion of the said lotte-
ry, out of the clear proceeds of the said lottery, from which fund
alone it is intended that the said alteration of the draw shall bo
made; And provided also, that it shall be the duty of the president
of the said company for the time being, within six months after
the completion of the drawing of the said lottery, to return on.
oath to the clerk of Kent county, a full and fair account of the
expenses and profits of the said lottery, and of the clear profits
derived therefrom, which said accounts shall be recorded by the
said clerk.
