1820.

person appointed as aforesaid, his executor or administrator, to
declare generally for money had and received for his or their use,
and Rive this act, and the special matter in evidence, in which
said suit or suits the. defendant shall be allowed but one impar-
lance, and the money so received and recovered shall be paid to
the directors chosen in virtue of this act, for the time being, who
shall apply the same to the opening, cutting, cleaning and repair-
ing the said ditch or drain, in the manner herein before directed.

CHAP. 71.

6. And be it enacted. That in case of the death, resignation,
refusal, or disqualification to art, of any of the persons chosen
directors, at any time hereafter, it shall and may he lawful for
the said other directors to meet as soon as conveniently may be
thereafter, at their place, of meeting as aforesaid, and choose a
person in his stead to act as director, till the next annual meeting
of the said proprietors, who shall be and he is hereby declared a
director, to all intents and purposes, until the succeeding annual
election.

CHAP. LXXII.

An Act authorising the Levy Court of Prince-George's County to levy a sum
of Money for purposes therein mentioned.

1. Be it enacted by the General Assembly of Maryland, That the

justices of the levy court of Prince-George's county are hereby
authorised and empowered, to agree for and purchase a quantity
of land, the. most convenient and proper for the erection of a
wharf, at or near the Town of Upper Marlborough, and in case
the owner or owners of such land shall refuse to make sale of so
much of the said land as said justices shall think necessary for
the building of said wharf, then the said justices shall he, and
they are by this act authorised and required, to issue their war-
rant to the sheriff of said county, requiring and commanding him
to summon and return a jury of good and lawful men of such
county, and not interested in or related to the owner of such land,
to be and appear before the justices on the premises, upon a cer-
tain day to he by them limited and appointed in such warrant,
which jury, upon their oath, to he by tiny one of the said justices
administered, shall inquire who is or are the owner or owners of
the said land, what is the value thereof, and what damages such
owner or owners will sustain; and the sum of money the said ju-
rors shall adjudge to the owner or owners of such land, shall be
assessed by said justices of said county, at the time of the mak-
ing their next county assessment, and shall be collected by the
sheriff or collector of said county, in the same manner as the
county assessment, and the sheriff or collector shall tender or pay
the same to the owner or owners of such land; and the said jus-
tices shall immediately after such valuation by the jury, cause
such land to be surveyed and laid out by the surveyor of said
county, with good and sufficient boundaries, and a certificate there-
of to be returned and recorded in the county records; and the
justices of the said county, and their successors, shall he and are
hereby vested with an estate in fee simple in the said land, for the
use of such county, for ever; and the said justices, or any two of
them, shall and they are hereby authorised and required, to treat
and agree with workmen to build and famish a good and conve-
