CHAPTER 420.

AN ACT amendatory of an act, passed at Janua-
ry Session, eighteen hundred and fifty-three,
chapter three hundred and sixty-three, entitled
an act, to amend the act incorporating the
Western Maryland Rail Road Company.

9, 1858.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That so much of the above
act to which this is an amendment, as requires

the President and Directors of the Western Mary-
land Rail Road Company, to make their bonds of
one million of dollars, redeemable in the year one
thousand eight hundred and seventy, he and the
same is hereby repealed, and the said President
and Directors are hereby authorized to make said
bonds redeemable prior to or within the year one
thousand eight hundred and ninety, and the said
President and Directors are hereby further au-
thorised to secure the payment of all or of any
part thereof, by a second mortgage on said road
and machinery, if they deem it expedient, and
authority is hereby granted to said Company, to
extend their road to any point within the limits
of the State, west of Hagerstown, that may be
determined on by said President and Directors,

SEC. 2. And be it enacted, That the right
power and privilege of the said Company to ac-
quire property for the construction of the said
Western Maryland Rail Road, and other im-
provements shall be the same, and executed in
the same manner, and under the same limitations,
conditions and restrictions in all respects with
those granted to the Baltimore and Ohio Rail
Road Company, for a like purpose, and that the
said Western Maryland Rail Road company, in
regard to rates of tolls, transportation, and the
protection of its property and its revenues, shall
nave the same powers, rights and privileges, which
are held by any other Rail Road Company char-
tered by this State.
