notice to said sheriff, to enter up a judgment
against the said sheriff and his sureties for such
amount as may he found to be due by the said
sheriff for non-payment or settlement of said ar-
rearages of taxes.

Present She-
riff to give
bond.

SEC. 2. And be it enacted, That it shall he the
duty of the present Sheriff of Baltimore county
to give bond in the manner provided in the fore-
going section, within one month from the passage
of this act; and in all other respects he shall be
subject to the provisions of said section.

Penalty for
neglect.

SEC. 3. And be it enacted, That if the pre-
sent or any future sheriff shall neglect, refuse or
fail to give the bond required by this act, in the
manner and at the time above provided, he shall
incur a penalty of two thousand dollars, which
said penalty shall be recoverable for the use of
the State of Maryland by indictment in the Circuit
Court for Baltimore county.

Not to be con-
strued.

SEC. 4. And be it enacted, That nothing in this
act shall be construed to relieve the sheriff's offi-
cial bond from liability for his failure or neglect
to collect and pay over said arrears of taxes.

In force.

SEC. 5. And be it enacted, That this act shall
take effect from and after the date of its passage.

AN ACT to authorise the Circuit Court for Bal-
timore City, to pass a decree for the sale of cer-
tain real estate belonging to the Third Presby-
terian Church of the City of Baltimore, and
others.

Preamble.

WHEREAS, it is represented to this General Assem-
bly, That a bill has been filed in the Circuit
Court for Baltimore City, by "the Third Pres-
byterian Church" of the City of Baltimore, and
others, for the sale of a lot of ground situate
in said city, heretofore used as a burial ground
by said Church, and certain lot holders, it be-
