temperate habits and of moral character, or the
written order of some physician; nor to any negro
or mulatto slave unless upon the like order of his
or her master, mistress or owner; and any person
or persons violating the provisions of this act
shall be liable to indictment in the Circuit Court
for Anne Arundel county, and upon conviction
thereof, shall be fined a Bum not less than fifty
dollars nor more than two hundred dollars for the
first offence; and if convicted the second time for
a like offence, be fined a sum not less than one
hundred dollars nor more than four hundred dol-
lars, and be confined in the jail of said county
until said fines shall be paid; the fines herein in-
curred to be collected in the same manner as simi-
lar fines are now collected by law.

SEC. 2. And be it enacted, That if any person,
having a license of any kind, authorising the sale
of spirituous liquors, shall violate the provisions
of this act, or permit any person in his or her em-
ploy to violate the same, at or in his or her
tavern, shop, house or place of business, or in or
upon his or her premises, with his or her knowl-
edge and consent, such license shall be suppressed
by the judge of said court, and be declared null
and void.

Penalty.

SEC. 3. And be it enacted, That the judge of
said court shall, whenever complaint may be
made to him by any two or more respectable citi-
zens of said city, or any officer of the county or
city, that any person having a license as afore-
said, is or has been violating the provisions of
this act, examine witnesses and inquire into such
alleged violation; and if upon such examination
and inquiry, it shall appear to his satisfaction
that the party complained against has been guilty
of such violation, the said judge shall have full
power immediately to suppress the license of such
person, and no new license shall be granted to
him or her.

SEC. 4. And be it enacted, That any one order
which may be given to any minor, free negro or
mulatto, or any negro or mulatto slave under the
provisions of the first section of this act, shall
not bo available for the purpose for which it was
given for a longer period than two days from its
date.
