every mile and in that proportion, for any greater
or less distance travelled, unless the vehicle drawn
shall have a tire over three incites; in winch case

one half the above rates shall he charged; Pro-
vided however, that no less than one half cent
shall be charged per horse, for passing through the
said toll-gate; and for every score of cattle, sheep,
hogs or other stock such rate of toll as is now al-
lowed by law to be received by the Franklin Turn-
pike Road Company in said county; and the said
company is hereby clothed and invested with all
and singular, the powers, rights, immunities and
privileges not inconsistent with the provisions of
this act, for the purpose of enforcing the collec-
tion of the tolls herein authorised, as are now al-
lowed by law to the several Turnpike Companies
in said county

Proviso.

SEC. 8. And be it enacted, That the said Com-
pany are hereby authorised to purchase and occupy
tor the purpose of a gatekeeper's house, not more
than one half an acre of ground contiguous to
the line of said road, at such point as they may
select for a toll-gate; and in the event of their in-
ability to obtain the same by consent of the ow-
ner thereof, it shall be lawful for the said Com-
pany to sue out of the Circuit Court for Baltimore
county an inquisition for the assessment and
valuation of said one half acre of ground; and
upon the compliance by said Company with the
finding of the jury in such inquisition, by the pay-
ment or tender in payment to the owner thereof
the amount prescribed, together with all costs and
charges thereon, it shall and may be lawful for
the said Company to occupy and possess the said
piece of ground for the purpose aforesaid.

SEC. 9. And be it enacted, That no dividend out
of the earnings of the said Company shall be de-
clared unless the said turnpike shall be kept in
good repair and condition for travel; and the
question of dividend shall bo determined by the
stockholders at large at the annual meeting in
March, for the election of President, Directors and
Officers' provided by the third section of this act ;
at which meeting a full and detailed statement
shall be exhibited of the finances of the said Com-
pany, which shall be submitted to the examina-
tion of a committee of the stockholders whose re-
