time and at such place as the said president and
directors may prescribe.

To be known
as the New Cut
Road Compa-
ny.

SEC. 5. And be it enacted, That the stockhold-
ers in the said company he and they are hereby
incorporated and constituted a body politic by
the name and style of "The New Cut Turnpike
Road Company," and by that name shall have
succession during the continuance of this corpora-
tion. And the same stockholders and their suc-
cessors, by the name aforesaid, may sue and be
sued, answer and be answered unto, in any court
of law or equity in the State, and may do and
execute any other matter and thing by the name
aforesaid, that they are authorised to do in virtue
of this act.

SEC. 6. And be it enacted, That the said com-
pany thus organized may proceed to turnpike the
said road upon the line designated and prescribed
in the first section of this act, preserving the
present width and depth of stone on said road
where already completed. And so soon as they
shall have constituted the said turnpike from the
beginning of the same at the end of the Franklin
road to Caleb Peddicord's farm, being a distance
of about one mile and a half, they are hereby au-
thorised to apply to the county commissioners of
said county for the appointment of three persons,
not stockholders in said company, as a commission
to examine and receive the said turnpike road,
and upon the report of the said commissioners or
a majority of them that the said turnpike road
has been properly made, is in good travelling
condition, and in all respects constructed in con-
formity to this act, the said county commissioners
shall issue a license to the said company to erect
a tollgate on the said turnpike road, on such part
thereof as the said company may deem proper, at
which may be charged such tolls as are herein-
after prescribed, and appoint a toll gatherer to re-
ceive the same.

SEC. 7. And be it enacted, That the said Com-
pany shall be authorised to charge and receive as
tolls on the said road, the following rates, viz :
for every horse, mule, mare or gelding which may
pass through the toll gate, whether led or rid-
den, or whether driven, attached to a vehicle of
pleasure or of burden, the sum of one cent for
