have the right to be heard with his proof, before
said justice of the peace against such suppression,
and the matter shall be tried and determined by
the said justice of the peace, according to the
justice and right of the matter, and no license
once suppressed shall be granted to the same
person.

Penalty for
using boat
without a li-
cense.

SEC. 4. And be it enacted, That any person of
color, on the shores of the Potomac river of
Charles or Prince George's county, who shall
have or use any boat on the said river without a
license as above provided for, shall upon convic-
tion before any justice of the peace of the res-
pective counties, be fined not less than five or
more than fifty dollars and costs, and the boat be
forfeited and sold by order of said justice of the
peace, and the said fine and forfeiture be collect-
ed and paid to the county commissioners of the
respective counties.

Slave to be
punished.

SEC. 5. And be it enacted, That any slave, of
Charles or Prince George's counties, who shall
have or use any boat in crossing said river or
going to Alexandria or District of Columbia,
without a special written permit of his master or
owner, shall upon conviction before a justice of
the Peace of the respective counties, be sentenced
to receive not less than ten nor more than twenty
lashes, and the boat, unless it belongs bona fide
to a white citizen, without notice of the user,
shall be forfeited as above.
