travel or other proper use of any street or alley
through which the same shall pass.

SEC. 2. And be it enacted, That where the ex-
cavation of any lot or lots, or parts thereof, as
aforesaid, to a depth of two feet or more, adjoin
any of the streets or alleys in the town of Havre
de Grace aforesaid, it shall he the duty of the
owner or owners of such lot or lots, to immedi-
ately erect and keep in constant repair, good and
sufficient walls or fences, along such streets and
alleys, or parts thereof, where such excavations
so adjoin, so as effectually to protect such tho-
roughfares from injury, and render the use thereof
by the public, as safe and convenient as before
such excavations were made.

SEC. 3. And be. it enacted, That the corporation
of the town of Havre de Grace, by its authorised
agents, the commissioners thereof, shall consent
to the temporary use of any street or public
thoroughfare of the said town, which may be re-
quired to enable the owner or owners of any ex-
cavated lot or lots as aforesaid, to comply with
the provisions of this act in constructing the said
underdrains, walls or fences.

SEC. 4. And be it enacted, That the commis-
sioners of said corporation, shall have full power
and authority to prescribe fines and penalties,
not less than ten nor more than one hundred dol-
lars, against the owner or owners of any exca-
vated lot or lots as aforesaid, who after receiving
ten days notice in writing, shall refuse or ne-
glect to comply with the provisions of this act,
and the fines and penalties prescribed as aforesaid,
shall be recoverable in the name of the said cor-
poration, before a Justice of the Peace of Har-
ford county, and when collected, shall be paid to
the treasurer duly appointed by the commission-
ers aforesaid, for the sole use and benefit of the
said corporation.
