tioned, shall be and they are hereby created, made
and declared to be a body politic and incorporate,
by the name and style of the trustees of the Cen-
tral School of Frederick county, and by that name
to have succession, and be able and capable at law
and in equity, to sue and be sued, implead and be
impleaded, and to hold, take and enjoy to them
and their successors, for the use of said school,
any estate in lands and tenements, goods, chattels
and effects, by gift, grant, conveyance, devise or
bequest, of any person or persons whatsoever ;

Provided, the whole of their property shall not at
any time exceed the value of thirty-five hundred
dollars, and the same to use in any manner they
may deem most beneficial to the said school, for
the purposes of education.

Proviso.

SEC. 2. And be it enacted, That the said trus-
tees and their successors, may have, hold and en-
joy the donation of Cordelia H. Downey, hereto-
fore made to the said school, according to the true
intent and purpose of the same, and for the use
and benefit of the said school.

SEC. 3. And be it enacted, That an election by
ballot for seven trustees, shall be held at Central
School House, some day between the first and tenth
days of August next, and on some day between the
first and tenth days of August, in every year there-
after, of which ten days notice shall be published by
the trustees, in such manner as they may direct, and
that every legal voter in said school district shall
be entitled to vote thereat.

SEC. 4. And be it enacted, That in case any of
the said trustees may die, resign, refuse to act, or
remove out of Frederick county, the remaining
trustees shall fill up the vacancy or vacancies.

SEC. 5. And be it enacted. That in case such
said annual election for trustees, as herein pro-
vided, should not take place, that the said trus-
tees under the appointment of this act, and their
successors, shall hold over until an election of suc-
cessors, and shall enjoy and exercise all the pow-
ers with which they are herein vested.

SEC. 6. And be it enacted, That the said trus-
tees or a majority of them, shall form a quorum
for the transaction of all business, that the said
trustees shall and may elect one of their own
