SEC. 4. And be it enacted, That this act shall
take effect from its passage.

CHAPTER 227.

In force.

AN ACT to incorporate the "American Band,"
of Frederick city.

Passed March
2, 1858.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That W. H. Derr, Philip M.
Englebright, George J. Doll, Howard Greentree,
Lawrence Bentz, Samuel V. Doll, George W.
Vanfossen, W. Luther Duvall, David W. Brooks,
Lewis Steine, Thomas Getzendanner, David M.
Lambert, John Ott, Levi J. Wolfe, Charles F.
Fleming, A. Roelkey, of Frederick county, and
others, officers and members of the American
Band and their successors, he and they are here-
by incorporated and made a body politic and cor-
porate, by the name of American Band, and by
that name may sue and be sued, and have a com-
mon seal, and the same at their pleasure alter,
and be entitled to use the powers and privileges
incident to such corporations.

Incorporated.

SEC. 2. And be it enacted, That the same cor-
poration shall be capable of taking and holding
real and personal estate, not exceeding in value
the sum of five thousand dollars, which estate
shall not be divisable among the members of the
corporation, but shall descend to their successors
for the general purposes of the corporation.

May hold real

SEC. 3. And be it enacted, That the said cor-
poration shall have power to make its constitu-
tion and by-laws, and to alter and amend the
same at pleasure; Provided, they do not conflict
with the Constitution and Laws of this State and
Laws of the United States.

May pass by
laws.

Proviso.

SEC. 4. And be it enacted, That nothing in
this act shall be so construed as to allow this
company to issue any note, token, scrip or device,
to be used as currency.
