defendant is a non resident, the Company may
proceed by attachment, and any property on said
road in his possession, shall be taken and held as
the property of said defendant.

Commission-
ers authorised.

SEC. 5. And be it enacted, That the said Com-
pany, shall be authorised to make rules regulating
the travel on the said road, and to impose penal-
ties not exceeding ten dollars each, for the breach
of the said rules, the said penalties to be sued for
before a justice of the peace, for the benefit of the
said Company.

Repealed.

SEC. 6. And be it enacted, That so much of the
act of eighteen hundred and fifty-three, chapter
three hundred and twenty-two, as is inconsistent
with the provisions of this act, be and the same is
hereby repealed, and this act shall take effect from
and after its passage.

AN ACT for the establishment of a system of
Public Schools in Somerset county.

ARTICLE I.

OP THE BOARD OP COMMISSIONERS.

Commission-
ers appointed.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That on the first Tuesday of
June, in the year eighteen hundred and fifty-
eight, and on the first Tuesday of September in
every second year thereafter, there shall be ap-
pointed one person in each Election District of
Somerset county, by the Judges of the Orphans'
Court thereof, to be Commissioners of Public
Schools, and to whom commissions shall be issued
by said Judges immediately after the said ap-
pointment, to be denominated "The Board of
Commissioners of Public Schools, of Somerset
county."
SEC. 2. And be it enacted, That the Judges of
the said Orphans' Court, of Somerset county, shall
