on said road, of stone, gravel, sand and dirt, so
as to make a turnpike of the same, and they shall
also have power, instead of the plank which is
now laid down on the said road, as fast as it may
he necessary to repair the same, to reconstruct the
said road of stone, gravel, sand and dirt, so as
eventually to change the said plank road to a
turnpike road.

SEC. 3. And be it enacted, That the said Com-
pany, shall be authorised to appoint as many toll
gatherers as the Company shall deem proper, who
shall collect the tolls at the following rates, that
is to say, for one mile or any distance less than
one mile traveled on said road, the said Company
shall be authorised to charge for every four heads
of cattle, sheep, hogs, horses or mules, in droves,
one cent, for every horse or mule, and rider or
animal led or haltered or in the yoke each one cent,
for every carriage of pleasure on wheels or runners,
one cent; and two cents for each animal drawing
the same; for every carriage of burthen on wheels
or runner, two cents, for each animal drawing the
same; for all distances over one mile, the said
Company shall be authorised to charge not ex-
ceeding the following rates, that is to say, for
every four head of cattle, horses, mules, hogs or
sheep, in droves, at the rate of one cent per mile,
for every horse or mule and rider, or animal led
or haltered or yoked, each one cent per mile, for
every carriage of pleasure on wheels or runners,
one cent per mile for the carriage, and two cents
per mile for each animal attached to the same ;
and for every carriage of burthen on wheels or
runners, for every animal attached to the same,

pany, shall be authorised to collect any tolls that
may be due from any person or persons, by suit
at law, before any justice of the peace, or in any
court having jurisdiction, upon the evidence of a
toll gatherer, or other agent of the Company, or
other lawful evidence; and in all cases when the
