Whaley, John E. H. Marshall, Joseph Donaway,
and William W. Mumford, be and they are hereby
appointed Commissioners, in the place of those
mentioned in the act of eighteen hundred and
forty, chapter two hundred and fifteen, and its
supplements, and that the said Commissioners
hereby appointed, or a majority of them, have
full power and authority to expend all money
which has been or may be raised under and in
virtue of the said act, in carrying out the original
design of the said act of eighteen hundred and
forty, chapter two hundred and fifteen, or if in
their judgment it will be more advantageous to
the interest of the county, in making a ditch or
canal, of such dimensions as they may deem ex-
pedient, from some point on the Pocomoke river,
to Birche's Branch, or tributary of St. Martin's
river.

how filled.

SEC. 2 And be it enacted, That if any of the
Commissioners herein named, shall die, resign or
refuse to act, or remove from Worcester county,
the remaining Commissioners shall appoint a
Commissioner in his place, so as to keep up the
number of five Commissioners, and the said Com-
missioners so appointed, or their successors, shall
have and exercise all the powers conferred by this
and the original act, and its supplements.

Repealed.
|
SEC. 3. And be it enacted, That the act of eigh-
teen hundred and fifty-three, chapter eighty, en-
titled an act to amend the act entitled, an act for
clearing out Pocomoke river in Worcester county,
by means of a Lottery, and the act of eighteen
hundred and fifty-six, chapter two hundred and
fifty-four, entitled an act amendatory of an act,
passed January session, eighteen hundred and
fifty-three, chapter eighty, be and are hereby
repealed.

SEC. 4. And be it enacted, That this act shall
take effect from the date of its passage.
