LAWS OF MARYLAND.

Commissioners
authorised.

SEC. 4. And be it enacted, That after the said
Avenue shall be declared open as a public high-
way, the County Commissioners of Baltimore
county, shall be authorised upon the application
of the owners of four-fifths of the ground fronting
thereon, to have the said Avenue graded on such
portions thereof as shall not be already graded,
and shall be authorised to levy upon the property
binding on that portion of the Avenue so graded,
a sum sufficient to pay said grading and all neces-
sary expenses thereto incident.

Compensation.

SEC. 5. And be it enacted, That the County
Commissioners aforesaid, shall be each entitled to
receive two dollars per day, whilst they are neces-
sarily employed in executing the duties aforesaid.

Shall exercise
lame powers.

SEC. 6. And be it enacted, That in case any
person or persons owning lands, property fronting
on said Avenue, shall be a femme covert, infant, or
non compos mentis, the Circuit Court for Baltimore
county, shall exercise the same powers over the
moneys coming to such person or persons, as are
usually exercised by that court in equity, under
its ordinary proceedings, for investment and re-in-
vestment of the estate of persons under the disa-
bilities aforesaid, respectively.

May appeal.

SEC. 7. And be it enacted, That in case any
person or persons, shall deem themselves ag-
grieved by the decision of the commissioners afore-
said, he, she or they shall have the right of enter-
ing an appeal to the Circuit Court for Baltimore
county, at any time within sixty days from the
time of said decision by said commissioners, and
the case shall be determined by the Judge thereof,
or by a jury at the option of cither party.

In force.

SEC. 8. And be it enacted, That this act shall
take effect from the date of its passage.
