thorised and directed to survey, lay out and lo-
cate, within ninety days from the passage of this
act, an avenue of the width of one hundred feet,
beginning for the centre thereof, at the intersec-
tion of the centre of O'Donnell street, with the
centre of Third street, as laid out on the plat of
the property of the Canton Company, then for the
centre of said Avenue, Northwardly with the cen-
tre of Third street, to the centre of Bank street ;
then for the centre of said Avenue with the centre
of Bank street, Westwardly to the centre of First
street, as laid out in the plat aforesaid; then for
the centre of said Avenue with the centre of first
street, as laid out in said plat, Northwardly to a
point where the centre of East Monument street
would strike, if continued Eastwardly in a straight
line from its present termination, at the Eastern
boundary line of the city of Baltimore.

SEC. 2. And be it enacted, That the said Com-
missioners or a majority of them, shall proceed to
condemn, value and assess, the damages to be
sustained, and the benefit to be derived from the
opening of such Avenue, by the owners of prop-
erty through which the same may pass, and as
soon as may be after such location, shall file a map
of said Avenue, so located, together with a report
of their proceedings, with the clerk of the Circuit
Court for Baltimore county, showing the amount
awarded to or assessed against each property
owner, in the laying out and locating said Avenue.

Shall proceed
to condemn.

SEC. 3. And be it enacted, That upon the assent
thereto of J. S. Nicholas Wilson, N. Nicholas,
Miles White, H. R. Glenn, W. W. Glenn, John
Glenn, W. H. Gatchell, Thomas G. Pratt, J. H.
Pleasants, President of the Canton Company,
Keyser and Manderson, and A. and J. Manderson,
owners of four-fifths of the ground fronting on
said Avenue, signified by the payment of the
damages and expenses assessed against them in
said report, to the Sheriff of Baltimore county,
to he by him distributed, the aforesaid Avenue
shall be deemed and taken as condemned, for a

public highway forever; Provided however, that
the opening of said Avenue shall not be a charge
upon Baltimore county, but that the same shall be
located and opened at the expense of the party
petitioners hereto.
