per mode of increase or abatement of any erroneous
assessment; to provide for the prompt payment of
the tax authorised to be levied by this act, and to en-
force by distraint or otherwise the payment of the
same, after such time as may be fixed by such ordi-
nance for such payments, and generally to facilitate
the collection of such tax.

Power to pass
ordinances.
|
SEC. 4. And be it enacted, That the said Mayor
and Common Council are hereby authorised to pass
all ordinances necessary for the preservation of the
health of the said city of Westminster, and for its
good government and general police, and to enforce
the observance of such ordinances by fines and pen-
alties not exceeding twenty dollars; and it shall be
the duty of any Justice of the Peace of the said coun-
ty, resident within the limits of said city, upon com-
plaint lodged before him of a violation of any ordi-
nance of the said Mayor and Common Council, to is-
sue a process for the recovery of the line or penalty
imposed by said ordinance, in the name of the said
Mayor and Common Council, against the party so
offending, and upon the return of such process, to
hear and determine such complaint as fully and effec-
tually as he now can any matter or thing arising un-
der his jurisdiction under the laws of the State; and
it shall be the duty of such Justice, before whom any
trial shall be had for a violation of any ordinance of
said Mayor and Common Council, to proceed in all
things as though the same were a matter arising un-
der the laws of this State, and he shall receive and
charge the same fees that are now allowed for sim-
ilar cases by law; and in default of the payment of
the fine or penalty which such justice may impose
under authority or any ordinance of said Mayor and
Common Council, he is hereby authorised to commit
the party fined to the county jail for a period of time
not exceeding ten days, and it shall be the duty of
the sheriff of Carroll county to receive into his custo-
dy and to confine in the jail all persons so committed
as though they were committed under the laws of the
State, and he shall charge and receive the same fees
and no more as are now allowed for the same services
done under and by virtue of the laws of this State.
