ed, as soon as may be convenient, to cause such
bridge to be rebuilt, or repaired, as they in their judg-
ment, upon the testimony had before them, as afore-
said, shall deem proper, upon its present site, of
sound and good material, and completed in the best
and most substantial manner; and they, or a major-
ity of them, are by this act fully authorised and em-
powered to agree with a contractor, or contractors,
for rebuilding or repairing said bridge; and the said
bridge shall be built or repaired under the immedi-
ate direction and superintendance of said commis-
sioners, or a majority of them.

SEC. 3. And be it enacted, That if either of the
commissioners, as aforesaid, shall die, or remove out
of the county in which he is commissioner, before
the completion of said bridge, or refuse to act, the
commissioner who shall have been appointed to act
with him, may appoint some other person, resident
of said county in which he was a commissioner, to
act in his place; and the person so to be appointed
shall have the same powers and authorities as are
vested in the said commissioner in whose stead he
shall be appointed as aforesaid.

SEC. 4. And be it enacted, That the commissioners
aforesaid, or a majority of them, shall render to the
county commissioners of their respective counties, at
their meeting next after the expenditure of said mo-
ney by them laid out and expended by virtue of this
act, in repairing or rebuilding said bridge; and that
the said county commissioners, in their respective
counties, shall make such compensation to said com-
missioners as they in their judgment may think
proper.

SEC. 5. And be it enacted, That it shall be the
duty of the commissioners to cause so much of the
timber of the present bridge, as may be found suita-
ble for the purpose, to be used in repairing the same,
or building of the new; and all such timber of the
present bridge that may be found unsuitable, shall be
exposed to sale, at ten days notice, for cash, and
the proceeds thereof applied to building or repairing,
as the case may be.

be used.

SEC. 6. And be it enacted, That if after repairing
or rebuilding of said bridge as aforesaid, there shall
be any surplus of the sums to be levied on the re-
spective counties, as aforesaid, in the hands of the
commissioners appointed by virtue of this act, it shall
be the duty of the said commissioners, or a majority
