SEC. 2. And be it enacted, That upon the return
of the said certificate of the said resurvey, it shall
be the duty of the said Commissioner to issue a pa-
tent upon the same, to the said James W. Bacon, the
only acting executor of the last will and testament
of the Romulus Riggs, deceased, bearing date on the
twenty-ninth day of May, eighteen hundred and for-
ty-three, and duly executed and admitted to probate
in the proper Court for the Register of Wills in the
city and county of Philadelphia, in the State of Penn-
sylvania, to have and to hold the said portion of said
part of land unto the said James W. Bacon, his heirs
and assigns, in trust for the sole use and benefit of
the heirs and devisees of the said Romulus Riggs, de-
ceased, as specified and named in said will, with
power to the said James W. Bacon, his heirs or as-
signs, to sell the said part of land at any time at pub-
lic or private sale, and to account for and pay over the
proceeds of said sale or sales, to the said heirs or de-
visees named in said will, or their heirs or assigns, ac-
cording to the provisions of said will of the said
Romulus Riggs, deceased, and also with power to
said James. W. Bacon and his heirs to sell, and by
good and sufficient deed or deeds, to pass and convey
the said legal and equitable title to the said lands to any

purchaser or purchasers of the same; Provided, how-
ever, that before any such patent be issued, the com-
missioner of the Land Office shall be satisfied that
the State has received all the composition money to
which she was entitled on the whole of said tract
called" Western Connection," as well as on the vacan-
cy to be added, if any under the warrant of resurvey
authorized to be issued as aforesaid; And provided
also, that all fees of office for services to be perform-
ed under this act, be previously paid.

Provisos.

SEC. 3. And be it enacted, That this act shall take
effect from the day on which it may be passed.
