structed and kept in repair by said Company for
the benefit of the public on which they are not per-
mitted by their charter to charge any toll because
the said distance is not equal to half a gate, where-
by the Company has been subjected to the expense
of constructing and keeping in repair the said three
miles, without receiving any tolls or compensation
for the use of the same by the public. And
whereas it is further represented by said Company
that by the sixth section of the act of Assembly of
December session eighteen hundred and forty-six
chapter ten, the said Company is prohibited from
charging persons residing on said road holding
stock of said company more than once each day
in passing through the said toll gates, which pro-
vision was originally intended to induce such per-
sons to take stock, so as to construct said road,
but said persons refused to do so, but have since
the construction of said road purchased stock, a
share or two, at the reduced price of two and three
dollars a share, which cost the original owner
twenty dollars per share, thereby to secure the
privilege aforesaid, and relieve themselves from
the payment of full tolls, which is in manifest vio-
lation of the intention of the original act of eigh-
teen hundred and forty-six, chapter ten. There-
fore,

Right to
charge toll.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the said Company shall have the
right to charge all persons passing over said road, a
toll equal to the length of the road now completed,
according to the rates per mile authorised by the ori-
ginal act to which this is amendatory, and so as to
include the said three or more miles now constructed,
and on which and for the use of which the said Com-
pany is now making no charge.

Repealed.

SEC. 2. And be it enacted, That the sixth section
of the act of Assembly of eighteen hundred and forty-
six, chapter ten, which enacted that all persons re-
siding on said road and holding stock therein shall
not be charged for passing through the toll gates on
said road more than once at each toll gate on any
single day, be and the same is hereby repealed.

In force.

SEC. 3. And be it enacted, That this act shall
have full force and effect from the date of its passage.
