CHAPTER 72
(Senate Bill 29)

AN ACT to repeal Section 70 (a) of Article 48 of the Annotated Code
of Maryland (1951 Edition), title "Inspections", sub-title "State
Tobacco Authority", and to enact Section 70 (a) in lieu thereof,
to stand in the place and stead of the section so repealed; to add
Sections 70 (ca), (g), (h), (i),

AND (J) and 71A to
the said Article and sub-title of the Code to follow immediately
after Sections 70 (c) and (f) and 71, respectively; to repeal and
re-enact, with amendments, Sections 70 (e),

of the said Article and sub-title of the Code; generally revising
the laws relating to the State Tobacco Authority and to tobacco
AND THE SALE THEREOF in this State.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 70 (a) of Article 48 of the Annotated Code of Mary-
land (1951 Edition), title "Inspections", sub-title "State Tobacco
Authority", be and it is hereby repealed and a new Section 70 (a) be
and it is hereby enacted in lieu thereof, to stand in the place and
stead of the section so repealed and that Sections 70 (ca), (g), (h),
(i)

AND (J) and 71A be and they are hereby added to
said Article and sub-title of the Code, to follow immediately after
Sections 70 (c) and (f) and Section 71, respectively, and that Sec-
tions 70 (e),

the Code, be and they are hereby repealed and re-enacted, with
amendments, and all to read as follows:

70.

(a). The Authority shall determine the opening and closing dates
for the Maryland tobacco auction markets. To assist it in making
this determination, the Authority shall call a meeting of licensed
commission sales agencies and loose leaf auction buyers not later than
July 4S-
DECEMBER 1 of each year. Written notice of this meeting
shall be given by the Authority to all licensed commission sales
agencies and loose leaf auction buyers at least ten days in advance
of the date of the meeting. Announcement of the opening and closing
dates shall be made public by the Authority not later than

DECEMBER 10 of each year.

(ca.) Every buyer of tobacco on the warehouse floor shall accept
the tobacco at the auction price at which sold to him, and may reject
the tobacco only under such terms and conditions as shall be estab-
lished by the Authority. The Authority shall regulate or prohibit the
deliberate tearing up of baskets of tobacco on the warehouse floor
by buyers of tobacco.

(e). It shall be unlawful for any officer, auctioneer or other em-
ployee of [a] any licensed tobacco commission sales agency to pur-
chase any tobacco on any licensed tobacco sales floor for and upon
