CHAPTER 497
(House Bill 541)

AN ACT to repeal and re-enact, with amendments, Sections 273, 274
and 277 of Title 22 of the Code of Public Local Laws of Baltimore
County (1948 Edition), title "Baltimore County", sub-title "Pro-
tection of Wild Life and Birds", sub-heading "foxes", relating to
type of fox as set forth in said sections.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 273, 274 and 277 of Title 22 of the Code of Public
Local Laws of Baltimore County (1948 Edition), title "Baltimore
County", sub-title "Protection of Wild Life and Birds", sub-heading
"foxes", be and they are hereby repealed and re-enacted, with
amendments, to read as follows:

273.   Any person or persons who shall shoot at,

SHOOT, TRAP OR POISON ANY red fox [that is
being pursued by a dog or dogs,] or shall dig out or in any man-
ner take from any den a female red fox or her young whelps or
kill or in any manner cause the death of such female red fox
or her young whelps during the period she is suckling them, shall
be deemed guilty of a misdemeanor and upon conviction before
a Justice of the Peace shall be fined not less than Twenty-five Dollars
nor more than Fifty Dollars for each offense, one-half of such fine or
fines to be paid to the informer and the other half to the Board of
County School Commissioners for the use of the public school of
said County. Nothing in this Act to be construed to prevent the
killing of said foxes at any time by any person while they are in
pursuit of his or her poultry; provided, however, that the killing of
said foxes be done within a reasonable time after such pursuit of the
killing of such poultry.

274.   In order to encourage the sport of fox hunting and to prevent
the indiscriminate and unnecessary destruction of red foxes, it shall
be unlawful for any person or persons to shoot at or shoot a red fox
that is being pursued by a dog or dogs.

277. It shall be unlawfull to trap, sell, buy or expose for sale any
red fox or red fox hide in Baltimore County, and it shall be unlawful
to transport any red fox or red fox hide from any place in Baltimore
County to any place without Baltimore County, and possession of any
red fox or red fox hide shall be prima facie evidence of a violation of
this section, but nothing in this Act shall be construed as to prevent
the killing of red foxes at any time by any person while they are in
pursuit or in the act of killing or carrying away his, her or their
poultry.

tricts 1, 9, 12, 13, 14 and 15 of Baltimore County but it shall be
