114. Sales to minors and intoxicated persons prohibited.

(b) In certain counties.—Provided, however, that in Carroll,
[Harford,] Somerset, Talbot, Wicomico and Worcester counties, no
licensee under the provisions of this article, or any of his employees,
shall sell or furnish any alcoholic beverages at any time to a minor
under 21 years of age, either for his own use or for the use of any
other person, or to any person who, at the time of such sale, or
delivery, is visibly under the influence of any alcoholic beverage. It is
hereby expressed to be the legislative intent that the provisions of sub-
section (a) of this section shall not apply to Carroll, [Harford,]
Somerset, Talbot, Wicomico and Worcester counties and the law in
these above-mentioned counties shall remain in the same force and
effect as if not amended by this section.

(g) Harford County.In Harford County any person charged with
selling or furnishing alcoholic beverages to a minor who establishes
to the satisfaction of the Court that he used due caution in an effort to
ascertain the age of the minor and that in the exercise of reasonable
caution he was deceived by the use of documentary evidence, and that
for such reasons he was not able to ascertain that the minor was in
fact a minor, shall not be found guilty of selling or furnishing alco-
holic beverages to a minor nor shall he or the licensee be subject to any
penalty or to the suspension or revocation of the license for such act.

SEC. 2. AND BE IT FURTHER ENACTED, THAT THIS ACT
IS HEREBY DECLARED TO BE AN EMERGENCY MEASURE
AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC HEALTH AND SAFETY, AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE SUPPORTED BY THREE-
FIFTHS OF THE MEMBERS ELECTED TO EACH OF THE TWO
HOUSES OF THE GENERAL ASSEMBLY, THE SAME SHALL
TAKE EFFECT FROM THE DAY OF ITS PASSAGE.

CHAPTER 486
(House Bill 383)

AN ACT to add Section 32A to Article 2B of the Annotated Code
of Maryland (1951 Edition), title "Alcoholic Beverages", sub-title
"Local Licenses and License Provisions", said new section to fol-
low immediately after Section 32 thereof, providing for an alcoholic
beverage license on any premises regularly licensed for horse
racing in Harford County and relating generally to the provisions
applicable to such licenses and the licensees thereunder.
