CHAPTER 260
(Senate Bill 150)

AN ACT to repeal and re-enact, with amendments, Section 242A of
Article 13 of the Code of Public Local Laws of Maryland, title
"Harford County", as amended by Chapter 784 of the Laws of
the General Assembly of 1953, sub-title "Explosives", making it
unlawful to manufacture, compound, store or keep explosives in
Harford County within one hundred seventy-five (175) feet of a
public highway and providing for a penalty for the violation
thereof.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 242A of Article 13 of the Code of Public Local Laws
of Maryland, title "Harford County", sub-title "Explosives", as
enacted by Chapter 784 of the Laws of the General Assembly of
1953, be repealed and re-enacted, with amendments, to read as
follows:

EXPLOSIVES

242A. It shall be unlawful in Harford County for any person,
partnership, corporation or association to manufacture, compound,
store, or keep fireworks or other explosives in Harford County
within one hundred seventy-five (175) feet of any public highway;
provided that this prohibition shall not extend to office buildings
or to any other buildings connected with the manufacturing process
in which the fireworks or other explosive materials are not actually
manufactured, compounded, stored or kept; and provided further,
that any person, partnership, corporation or association storing
dynamite for retail sale may secure a permit from the Sheriff of
Harford County authorizing such storage under such safety rules
as the Sheriff may prescribe. Any person, partnership, corporation
or association violating the provisions hereof shall be deemed to be
maintaining a public nuisance, and shall be guilty of a misdemeanor
and shall be subject to a fine not exceeding $1,000.00; provided that
one conviction under this Act shall not bar a subsequent prosecution
if the offense is continued.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1955.
