His duty be-
fore he pro-
ceeds to exe-
cute or dis-
train.

2. AND BE IT; ENACTED, That it shall be
the duty of the said Ezra Mantz, before he proceeds
to execute or distrain the property of any person or
persons for officer's fees or public, dues in virtue of
this act, to deliver to such person or persons chargea-
ble with the same, at least thirty days previous to le-
vying such execution or distress, an account written
in words at full length of the officers fees or public
dues demanded of him, her, or them, with an affida-
vit annexed if required; that he hath not received
any part thereof, nor any thing as security or satis-
faction; for the same, more than credit given to the
best of his knowledge.

3 AND BE IT ENACTED, that the said Ez-
ra Mantz, before he derives any benefit from or un-
der this act, shall lodge a copy of his collection
books in the clerk's office of Frederick county, to be
open for the inspection of all persons, interested in
the same.

CHAPTER 59.

An act to regulate the fees of the Register of the
Court of Chancery.

SEC. 1. BE IT ENACTED by the General As-
sembly of Maryland, That after the first day of Feb-
ruary next, the register of the court of chancery, for
the performance of the duties of his office, shall not,
under the penalty of one hundred dollars for every
offence, demand, ask for or receive, any higher or
other fees than are allowed by law to the clerks of the
county courts for the same services.

2. AND BE IT ENACTED, That for any servi-
ces, to be performed by the register of the court of
chancery, and for which no allowance is made to the
Jerks of the county courts as aforesaid, the said re-
gister shall charge one half of the respective fees
now allowed to him by law, and no more; and the
said register shall not, after the first day of February
next, under the penalty of one hundred dollars for
every offence, demand, ask for or receive, any
higher or other fees for such services.

3. AND BE IT ENACTED, That the penalties
which may accrue in virtue of this act, shall be re-
covered by indictment in Anne-Arundel county
court, and that one half thereof shall be paid to the
person or persons prosecuting for the same, and the
