certain day, of which ten days notice at least shall
be given to the party or parties interested, and the
said jurors, when so met, and having each first taken
an oath, before some justice of the peace, that he
will without favour, affection, prejudice or partiali-
ty, assess the damages sustained by the person or
persons at whose request such inquisition shall be ta-
ken, by reason of opening the aforesaid road
through his, her or their land, shall thereupon pro-
ceed to assess and value the damages accordingly,
taking into consideration the advantages and disad-
vantages, (if any; ) and such inquisition and valua-

tion shall be final and conclusive between the parties
respectively; Provided, That the said roads shall not
be opened through the buildings, gardens, yards or
orchards of any person, without his, or her consent.

Proviso.

4. AND BE IT ENACTED, That if the owner
or owners of the land which belonged to James
Croxall, at the time of the passage of the above
recited act, shall set up a boat, or cause it to be done
by others, until they have paid the said Francis Hol-
land the expence which he has been at by opening,
straightening & making said road, they shall forfeit &
pay to the said Francis Holland, the sum of two hun-
dred dollars, to be sued for and recovered as sums of
like amount are sued for and recovered.

CHAPTER 31.

Forfeit in a
certain case.

An act authorising Ezra Mantz, late sheriff of Fred-
erick county, to complete his collection.

3, 1812.

WHEREAS, It is represented to this General
Assembly by the petition of Ezra Mantz late sheriff
of Frederick county, that from various causes there-
in set forth, he has not been able to complete his col-
lection within the time limited, and that there is still
due to him as sheriff of said county, considerable
sums of money, and praying that a law may pass to

enable him to collect the same; Therefore,
SEC. 1. BE IT ENACTED by the General As-
sembly of Maryland, That the said Ezra Mantz be,
and he is hereby authorised to collect, until the first
day of December eighteen hundred and thirteen, all
balances due him as sheriff of Frederick county, for
the year eighteen hundred and twelve, in the same
manner as he could or might have done within the
time limited by law; any law to the contrary not-
withstanding.
