CHAPTER 173.
An act to make public an old road leading from
South River Church, to intersect the Annapolis
road to West River.
|
|
|
Preamble.
|
WHEREAS, It is represented to this General
Assembly by the petition of sundry inhabitants of
Anne-Arundel county, that the convenience of the
public would be promoted by opening and establish-
ing an old road called the Club House Road, leading
from South River Church to intersect the Annapolis
road to West River: Therefore,

SEC. 1. BE IT ENACTED by the General As-
sembly of Maryland, That Colonel Richard Har-
wood, William Stewart and Joseph Watkins, be,
and they are hereby appointed commissioners, to lay
out and open (at the expense of those persons who
shall conceive themselves benefited thereby) the old
road (not exceeding twenty feet wide) beginning at
the road which passes South River Church, and run-
ning intersects the Annapolis road leading
to West River.

Plot.
|
2. AND BE IT ENACTED, That the said
commissioners or a majority of them, shall and they
are _____cted and required, to make or cause
to _____ a plot of said road, and when surveyed
as aforesaid, and shall make return of the said plot
together with a certificate of the courses of said
road to the clerk of Anne-Arundel county, to be re-
corded among the records, of said county; and when
the same shall be laid out, made and opened as di-
rected by this act, the said road shall forever thereaf-
ter be deemed a publick highway, and shall be kept
in repair as other public roads of Anne-Arundel

Proviso.
|
county: Provided, The said commissioners shall not
lay out and open the said road through the buildings,
gardens, orchards or meadows of any person or per-
sons without their consent.

Damages.
|
3. AND BE IT ENACTED, That the said com-
missioners or a majority of them, shall ascertain and
value what damage may be sustained by any person
or persons through whose land the said road shall
pass, and tile same when so ascertained shall be paid,
or secured to be paid, by the persons who may ap-
ply to have the said road laid out, to the person or
persons who may be entitled to receive the same,
before they proceed to open the said road.
