CHAPTER 114.

An act to make public a road from Hancock, in
Washington county, to Cumberland, in Allegany
county, and for other purposes.

1812.


Passed Dec.

23, 1812.

BE IT ENACTED by the General Assembly of
Maryland, That the road from Hancock, in Wash-
ington county, to Cumberland, in Allegany county,
as located by Messrs. Eli Williams and Thomas
Moore, under the direction and authority of the levy
court of Allegany county, be, and the same is hereby
declared to be a public road, and shall be kept in re-
pair as other public roads are in said counties.

An act for the benefit of the heirs of Joshua Flem-
ing, late of Worcester county, deceased.

23, 1812.

SEC. 1. BE IT ENACTED by the General As-
sembly of Maryland, That the orphans' court of Wor-
cester county be, and they are hereby authorised and
empowered, if they think it will be advantageous to
the heirs of Joshua Fleming, late of Worcester
county, deceased, to appoint a trustee to sell and dis-
pose of all the real estate of the said Joshua Fleming,
in Worcester county, at such time and upon such
terms as shall be prescribed by the said orphans'
court; and that upon the payment of the whole of
the purchase money, the said trustee shall convey
the said real estate to the purchaser or purchasers;
which conveyance being duly made shall be sufficient
to convey all the right, title, claim and interest, of, in
and to the said real estate, which the said Joshua
Fleming had share at the time of his death, and which
descended to his heirs.

2. AND BE IT ENACTED, That the trustee to
be appointed by the said orphans' court, before he
proceeds to exercise any of the powers to be vested
in him by virtue of said appointment, shall give bond
to the State of Maryland, in such penalty and with
such security as the orphans' court of said county
shall direct, for the faithful performance of all and
singular the powers by this act directed to be vested
in him; which bond shall be recorded by the register
of wills for the said county; and the same or an office
copy thereof may be put in suit by any person, or per-
