CHAPTER 94.

Mar. 1, 1854.

AN ACT to authorise a wharf to be constructed at
Georgetown, in Kent county, on Sassafras river and
a Granary to be erected.

Commission-
ers appointed.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That George W. Spencer, Thomas K.
Stephens and John Frazier, Junior, be, and they are
hereby appointed commissioners, to examine and lay off
a portion of the waters of Sassafras river opposite the
lot of Andrew Woodall, formerly the Allen Lot, lying
in Georgetown, in Kent county, extending the width
of said lot, and if they deem it necessary, immediately
opposite George's Lane in said town, extending from
high water mark, to a depth of water sufficient for ves-
sels carrying grain and other produce, to float at ebb
tide, and to condemn so much of the said water and
the bed of the Sassafras river, as may be necessary for
the construction of a wharf and granary thereon, by said
Andrew Woodall; Provided, such appropriation of the

Proviso.

river shall not in their opinion obstruct or prejudice the
navigation of said river.

Free for pub-
lic use.

SEC. 2. And be it enacted, That any wharf that
may be constructed immediately opposite to or at the
end of George's Lane, shall be free for public use, and
that no granary shall be erected on that part of any
such wharf, and that the condemnation or private use
by the said Andrew Woodall, or his assignees or repre-
sentatives, of the portion extending out from his lot,
shall continue no longer than the wharf, shall be kept
up.

SEC. 3. And be it enacted, That the said commis-
sioners shall make out a return or report of their pro-
ceedings, under their hands, and file the same with the
clerk of the circuit court for Kent county, by the first
day of January next, and that the said clerk shall record

the same at the expense of the said Andrew Woodall,
who shall also be answerable to the commissioners for
their per diem of two dollars for their services, and that
the said wharf shall be constructed within three years
from the passage of this act, and not afterwards, and
that this act shall take effect from its passage.
