CHAPTER 39.

AN ACT to authorise the Circuit Judge for Anne Arun-
del county, to ascertain whether Elizabeth Earnshaw,
a prisoner in the jail of said county is insane, and to
discharge her from imprisonment, if he shall think
her of sane mind.
|

Preamble.
|
WHEREAS, At the October term, eighteen hundred and
fifty-three, of Anne Arundel circuit court, a certain
Elizabeth Earnshaw was found guilty of an assault
with intent to kill, and the jury also found that she
was insane at the time of commuting the offence,
and at the time of the rendition of said verdict, and
the said Elizabeth Earnshaw is now confined in the
jail of said county, as an insane person, though be-
lieved by many persons to be perfectly sane, and it
is doubted whether there is any authority now pos-
sessed by the judge of the said court to older her re-
leased; Therefore

Authority to
discharge.
|
SECTION 1. Be it enacted by the General Assembly
of Maryland, That the judge of the circuit court for
Anne Arundel county be, and he is hereby authorised
and empowered, to enquire and ascertain whether the
said Elizabeth Earnshaw is insane or of sound mind,
and to order her to be discharged from confinement,
if he shall determine her to be of sane mind.

SEC. 2. And be it enacted, That this act shall take
effect from the day of its passage.

Mattawoman Run, at and near the point at which the
Stage Road from Port Tobacco to Glymont crosses
said Run, and to authorise the building of a Bridge
over said Run.
