said fine, penalty or forfeiture and costs when so im-
posed or adjudged, there to remain, or stand committed
until such fine, penally or forfeiture and costs be paid,
or until discharged as hereinafter provided, and it is
hereby made the duty of the sheriff of said county to
receive, and safe keep all persons who shall be so com-
mitted to the county jail, according to the tenor of such
commitment, and for which he snail be paid by said
corporation, such fees and compensation as are now al-
lowed in criminal commitments.

Power to dis-

charge.

SEC. 17. And be it enacted, That the said burgess,
or any justice of the peace as aforesaid, who may have
directed any such committment, shall have power to
order any person so committed to be discharged from
the custody of the sheriff or other officer having charge
of such person, and the said burgess or any justice of
the peace as aforesaid, shall have power to issue sub-
poenas for witnesses whose attendance shall be enforc-
ed by attachment, and the said burgess or said justice
of the peace, and either or any of said constables shall
be entitled for their services in each case, and the wit-
nesses for their attendance, to the same fees as are al-
lowed by law for similar services and attendance in
cases of the recovery of small debts out of court; and

to alms house.

the said burgess or any justice of the peace as afore-
said may commit to the alms house of Frederick any
vagrant or pauper, or fortune teller, or habitual beggar,
or any person that begs from house to house, or from
passers by, or any person or persons having no visible
means of employment from property or labor, or whose
permanent support is not provided by his or her friends
or relations, or any person who cannot give account of
the means to which his or her livelihood is obtained,
found within the said town; and it is hereby made
the duty of the keeper of the said alms house to re-
ceive and safe keep all persons so committed, according
to the tenor of such commitment, and he shall put any
person so received to work according to his or her
ability.

SEC. 18. And be it enacted, That nothing herein
contained shall be so construed as to authorise or em-
power said corporation to issue any note, token, certifi-
cate, or evidence of debt to circulate as currency.

SEC. 19. And be it enacted, That the acts of eigh-
teen hundred and twenty-four, chapter twenty-nine,
incorporating the town of Emmittsburg in Frederick
county, and prescribing the duties, powers and limits
