limits of the corporation, the commissioners or a majori-
ty of them, for the time being, shall elect a burgess, or
any such commissioner, to fill the vacancy for the re-
sidue of the term, and until a successor shall be elected
and qualified to act as such, and should the inhabitants
of said corporation at any time neglect to make an elec-
tion at the times required by this act, the power of elect-
ing a burgess and commissioners, shall not therefore
cease, but the right and power of said inhabitants shall
continue the same as though such an election had been
made, and the burgess and commissioners for the time
being shall continue and remain in office until such
election shall be held, and their successors are qualified
to act as such.

SEC. 14. And be it enacted, That the citizens of the
said town, and all persons holding property therein, shall
be competent witnesses in all actions arising under this
act, or the by-laws and ordinances of said corporation
if exempted from all other exceptions than those of in-
terest, as an inhabitant of the said town, or members
of said corporation.

SEC. 15. And be it enacted, That all monies arising
from taxes, fines, forfeitures and penalties imposed by
virtue of any by-law or ordinance of said corporation,
shall be appropriated to the uses thereof, in such man-
ner as may by ordinance be directed.

SEC. 16. And be it enacted, That all fines, penal-
ties, forfeitures, under the by-laws or ordinances oft
the said corporation, shall be recovered before the bur-
gess aforesaid, or before a justice of the peace of Fre-
derick county, and the same shall be imposed or ad-
judged by the burgess of said town, or by any justice of
the peace of said county upon warrant to be issued by
him against the offender or offenders to the constable of
said corporation, or to any constable of said county,
and it is hereby made the duty of the county constables
to serve all writs so issued under the same penalties as
in cases of small debts, and for which he shall receive
the same fees to be paid by said corporation, and the
said burgess, or any justice of the peace as aforesaid,
shall have power when imposing any fine, penalty or
forfeiture for the violation of any of said ordinances to
direct and order the person convicted of the same to be
committed to the public jail of said county, or to an
appropriate place of confinement within the corporation,
which the burgess and commissioners are hereby au-
thorised to provide in case he shall fail or refuse to pay
