CHAPTER 247.

AN ACT entitled a supplement to the act to re-organ-

ise the common schools of St. Mary's county, and to
levy a tax for the support of the same, passed January
session eighteen hundred and fifty-three, chapter two
hundred and seventy-nine.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That it shall be the duty of the school
commissioners of St. Mary's county, and they are here-
by empowered, to make such changes from time to
time, in the lines and boundaries of the several school
districts, and to create such additional school districts
in said county, as in their judgment may be requited
for the convenient education of the children therein.

SEC. 2. And lie it enacted, That if it shall happen
that any school shall not be kept open ten months in a
year, as required by the fourteenth section of the act to
which this is a supplement, it shall notwithstanding be
the duty of said school commissioners to pay or cause
to be paid to the order of the trustees of such school
district, so much of a distributive portion of the money
which shall be in the hands of said school commission-
ers for distribution, as shall be a fair pro rata compen-
sation for any shorter period than ten months, during
Which any school shall be kept open by any teacher
properly authorised to open the same.

SEC. 3. And be it enacted, That if any money shall
be left in the hands of the treasurer of the school fund
for St. Mary's county, after defraying expenses, and
paying teachers of the several school districts annually,
the same shall be invested by the said treasurer, under
the direction of the said board of school commission-
ers, and when invested, the said board of school com-
missioners may collect the same, and if necessary may
sue in the name of the State of Maryland, for their use,
to recover any amount that may be thus due them, and
the said fund shall all times be under the control and
management of said board of school commissioners, to
be managed and disposed of by them, as shall in their
judgment best subserve the purposes of education in the
primary schools in said county.
