CHAPTER 202.

Mar. 10, 1854.

AN ACT to authorise the Circuit Court of Baltimore
county, to confirm the partition of the real estate of
James Calder, deceased.

Preamble.

WHEREAS, it is represented to this General Assembly,
that by an agreement made between Margaret Cal-
der, Thomas Little and Mary his wife, James Turn-
er and Sarah his wife, Michael Withers and Charlotte
his wife, the said Margaret, Mary, Sarah and Char-
lotte, being the surviving children of James Calder,
deceased, Abraham Slade, William R. Gillis and
Joshua Kidd, were appointed to make and by virtue
of said agreement did make in or about the year
eighteen hundred and eleven a partition of the real
estate of which said James Calder, died seized, into
ten lots, in which partition lots numbers one and
nine were allotted to Margaret Calder, lots num-
bers three, five, and ten, to Mary Little, lots num-
bers two and seven to Sarah Turner, and lots num-
bers four, six and eight, were allotted to Charlotte
Withers; , that the said Margaret Calder, now
Margaret Parks, Sarah Turner and Charlotte With-
ers, have ever since the said partition held and do
now hold in severally the lots to them respectively
allotted in and by said partition, and that the said
Mary Little held in severally until her death and her
children and the children of a deceased child do now
hold the lots to her allotted in and by said partition ;
and whereas, it is just and expedient that the said
partition if proved to be fair and equitable should be
confirmed and the lots allotted to each of the chil-
dren of said James Calder should be held in several-
ly by said child for life and after death by those
entitled thereto in remainder under said will; now
Therefore,

Authority to
ratify.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That upon the application to the circuit
court of Baltimore county, of any one or more of the
parlies interested in the said partition made as aforesaid
by agreement of Margaret Calder, Thomas Little and
Mary his wife, James Turner and Sarah his wife,
Michael Withers and Charlotte his wife, by bill or peti-
tion and upon notice to all the parties interested the
said court shall have full power upon being satisfied that
