CHAPTER 201.

AN ACT to empower the Circuit Court for Frederick ,
county, as a court of equity to confirm a sale therein
named and to authorise the conveyance of the pro-
perty to the purchaser.

Mar. 10, 1854.

WHEREAS, Isaac Brower, of Frederick county, was by
a decree of the Circuit court, of said county, selling
as a court of equity, appointed trustee to sell the real
estate of a certain Robert Upcraft late of said coun-
ty, deceased, but through a mistake in making the
exhibits to the said proceedings a deed for part of
said real estate was accidentally omitted, and such
real estate, consequently not embraced in said de-
cree; and whereas, the said trustee without being
aware of such omission, sold the whole of the real
estate of said deceased, reported such sale and had it
ratified by said court, and now desires said court to be
clothed with the power of confirming and making
valid said sale, and to authorise him to convey the
said real estate to the purchaser thereof; Therefore,

Preamble.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the said court be, and the same is
hereby authorised and empowered to confirm and make
valid the said sale of the said real estate made and re-
ported by the said Isaac Brower, trustee as aforesaid,
and to authorise the said Isaac Brower, trustee as afore-
said to convey the same to the purchaser or purchasers
thereof, as fully as if the whole of said real estate had

been embraced in said proceedings in equity; Provid-
ed, the said court shall deem such sale advantageous to
all the parties interested therein.

Proviso.

SEC. 2. And be it enacted, That this act shall take
effect from the day of its passage.
