sheriff of such county until said fine, with the cost of
prosecution, is paid; and the said boats, seines and fix-
tures shall be condemned by said justice of the peace,
and sold at public sale, fur cash, after ten days notice,
the one half of the proceeds thereof, as also the one
half of said fine, to be paid to the informer, who shall
be a competent witness, and the residue to the orphans
court, for the use of the primary schools of such
county.

Gill nets.
|
SEC. 3. And be it enacted, That no person or per-
sons shall haul, drift or fish any gill net within the wa-
ters, bounds or berths of any regularly hauled fishing
landing within the periods aforesaid, without the per-
mission of the owner or owners thereof, and any per-
son so offending shall be subject to like forfeitures, and
liable to the same fine as is prescribed by the second
section of this act.

Duty of sheriff.
|
SEC. 4. And be it enacted. That it shall be the
duty of the sheriff and constables of Prince George's
and Charles counties to arrest any person or persons
violating the provisions of this act, and to take charge
of all boats, seines and fixtures then in their possession,
and cause such person or persons to be taken before
some justice of the peace where the same may occur,
to be dealt with according to the provisions of this
act.

SEC. 6. And be it enacted, That this act shall take
effect from its passage.
