are hereby appointed and constituted a board of com-
missioners, whose duties shall be to locate the said
court house and jail to be erected for the use of said
county, to contract for the building of the same, and
perform such other duties as are prescribed by this
act.

SEC. 2. And be it enacted, Thai the commissioners
or a majority of them, appointed by the first section of
this act, be, and they are hereby authorised and em-
powered, to select and determine, which of said lots of
ground shall be selected and accepted for the purpose
of erecting a court house and other appropriate buildings
thereon for the use of said county.

SEC. 3. And be it enacted, That in case the said
commissioners or a majority of them, should upon an
examination of the grounds thus offered to the county
by said persons, be of the opinion that neither of said
lots of ground would be suitable for the erection of said
court house and other appropriate buildings, then in
that case the said commissioners or a majority of them,
are hereby authorised and required to select some other
ground for said purpose, at or near said place of Tow-
sontown, and to pay such price for the same as they in
their judgment may consider the said ground to be
worth, and the party or parties from whom the same
may be purchased, may agree to take for the same.

SEC. 4. And be it enacted, That m case the said
commissioners or a majority of them, shall be of the
opinion that the quantity of ground or land which has
been tendered to the county for the objects aforesaid is
not sufficient for the accommodation of the public, then
they are hereby authorised and empowered to purchase
such additional ground or land for said purposes, and
the said commissioners or a majority of them, may
erect the court house and jail on the same lot, or on
separate lots of ground, as they in their discretion may
think proper.

SEC. 6. And be it enacted, That any lot or lots of
ground, or tract or tracts of land, which the said com-
missioners or a majority of them, may receive by dona-
tion or acquire by purchase, for either of the purposes
aforesaid, shall be conveyed to the county commis-
sioners for Baltimore county, for the use of said county,
by a good and sufficient deed or deeds in fee simple.
