control of the orphans court of said county, for common
school education.

SEC. 10. And be it enacted, That it shall be the
duty of the trustees of each school district, after they
have been organized, annually to give ten days notice
in writing before each annual election for trustees, set
up at some public place, of the time and place of hold-
ing such, election, and if for any reason an election
should not take place on the day notified, they shall
give a further notice till an election is effected, and
the old trustees shall hold their office till their successors
are appointed, and nothing in this act shall be so con-
strued as to prevent the school commissioners from act-
ing as trustees, if elected as such.

SEC. 11. And be it enacted, That the orphans
court of Calvert county shall draw upon the commis-
sioners' court of said county, in favor of the trustees of
any or all of the school districts of said county, who
may have obtained a site and built a school house
thereon, for such sum as may be necessary, not to ex-
ceed one hundred and thirty dollars, including all vol-
untary contributions thereto, the same to be paid by the
commissioners of the county out of arrearages of interest
now due from the county to the common school fund,
under the act of eighteen hundred and forty-five, chan-
ter fifty-eight, and not heretofore checked out by the
orphans court of said county, for educational purposes.

SEC. 12. And be it enacted, That nothing contained
in section nine of this act, shall be construed to apply
to the academy fund of said county, for one year from
the passage of this act.

SEC. 13. And be it enacted, That if at any time,
the pupils in any of the schools, established under the
provisions of this act, should become so few in number,
as to warrant, in the judgment of the three commis-
sioners residing in the election district where said school
is located, a diminution or suspension of the donation
to said school, then the orphans court may, upon the
recommendation of said commissioners, either diminish
or suspend altogether said donation, due notice of which
shall be given to the trustees of said schools, three
months preceding the diminution or suspension of said
donation.
