to keep a diary of the attendance and a list of the names
of the children, and report the same to the orphans
court, together with the number of months the school
has been kept open, and the name of the individual
they have employed as teacher.

Right of ap-
peal.

SEC. 5. And be it enacted. That any persons deem-
ing the amount of tuition assessed by the trustees too
great, shall have the right of appeal to the three school
commissioners living in their election district, and the
decision of said commissioners shall be final.

Bills not paid

hands of col-
lector.

SEC. 6. And be it enacted, That when any one
who may be in arrears for tuition, shall neglect or refuse
to pay, the trustees shall place bills for the same, regu-
larly proven by the teacher, into the hands of the county
collector, who shall collect the same, in the same man-
ner that county taxes are collected, adding thereto six per

cent., which six per cent, shall go to the collector, to
compensate him for his trouble; and it shall be the duty
of the collector to receipt for the tuition fees thus placed
in his hands by the trustees, and for the collection and
prompt payment of the same, his official bond shall be
responsible.

Share of
school fund.

SEC. 7. And be it enacted, That when the school
district shall have been laid out, the trustees elected,
the site obtained, the school house erected, and a quali-
fied teacher employed in any of the school districts for
at least six months, then the trustees of said school may
call upon the orphans court of the county for their an-
nual share of the school fund of said county, which
shall not be less than two hundred dollars per annum,
and if the funds at the disposal of the court will justify
it, they may at their discretion increase the sum given to
those schools that have a large attendance of pauper
children, to any sum not exceeding three hundred dol-
lars.

Duty of coun-
ty commis-
sioners.

SEC. 8. And be it enacted, That it shall be the
duty of the county commissioners of Calvert county,
to have collected and deposited annually in the Far-
mers' Bank of Maryland, at Annapolis, subject to the
check of the orphans court of said county, seven hun-
dred and fifty dollars, it. being the interest arising from
the money borrowed by the county from the primary
school fund in December session, eighteen hundred and
forty five, chapter fifty-eight.

Academy
fund.

SEC. 9. And be it enacted, That the fund heretofore
known as the academy fund of Calvert county, be, and
the same is hereby made a part and parcel of the pri-
mary school fund of Calvert county, and subject to the
