LAWS OF MARYLAND.

Persons to be
appointed to
examine road.

SEC. 4. And be it enacted, That whenever two
miles of the said road shall have been made under this
charter, and shall be in a fit and proper condition for
travel, the board of directors of the said corporation may
report the fact to the commissioners of Baltimore coun-
ty, who shall appoint three competent and disinterested
persons to examine the same, and if the said examiners
or a majority of them shall report under their hands and
seals, to the said commissioners that at least two miles
of the said road have been made under this charter,
and are in a fit and proper condition to travel, and how
many miles thereof are in such condition, then it shall
and may be lawful to, and for the said corporation to
erect one or more toll gates upon the said road, and re-
ceive and demand for travel thereon at the following
rales per mile, for every mile in such condition, viz: for

every wagon or carriage of any description, and for
every animal of every kind at the same rates that are
charged or allowed to be charged upon the Baltimore
and Harford Turnpike Road; and as the said corpora-
tion progresses with the making of the said road, it
may make similar reports from time to time, which re-
ports shall be acted upon in like manner and with sim-
ilar results, and the said corporation shall have like
power and authority to arrest and detain any cattle,
beast or vehicle, that may come, be driven or brought
upon the said road, until such toll be paid, as is now
by law given to or vested in any turnpike road compa-
ny in this State; or the said corporation may collect its
said tolls by suit or warrant as other debts are collected;
but if at any time the grand jury of the said county,
shall present the said road as unfit for use and travel,
then and in such case all right to collect tolls thereon,

shall cease and be suspended, until the same be placed
in a fit and proper condition for travel as aforesaid, and
until it shall be reported and examined and approved
as aforesaid.

SEC. 5. And be it enacted, That nothing in this act
shall be so construed as to authorise said corporation to
issue any note, token or scrip, devise or other evidence
of debt, to be used as a currency; and the legislature
