CHAPTER 106.

CHAP. 106.

AN ACT amendatory of the act of December session,
eighteen hundred and thirty-seven, chapter ninety-
seven, entitled, an act to authorise the appointment

of Commissioners to take the acknowledgment of
deeds and instruments of writing under seal, out of
the State of Maryland.

SECTION 1. Be it enacted by the General Assembly

of Maryland, That hereafter the commissioners au-
thorised by virtue of the act of December session, eigh-
teen hundred and thirty-seven, chapter ninety-seven,
entitled, an act to authorise the appointment of com-
missioners to take the acknowledgment of deeds and
instruments of writing under seal out of the State of
Maryland, shall be appointed biennially, and shall
hold their office by the same tenures, as other civil

officers of this State, appointed in pursuance of the
provisions of section fourteen, of article second of the
Constitution.

SEC. 2. And be it enacted, That all commissions
heretofore issued by the Executive authority of this
State, to any commissioners to take the acknowledg-
ment of deeds, and instruments of wilting under seal,
out of the State of Maryland, shall unless sooner recall-
ed and vacated by the Governor, continue and be in
full force and authority, until the first Monday of May
next, and until their successors are appointed and duly
qualified according to law, and the Governor shall
forthwith cause a copy of this act to be forwarded to
each of the said commissioners, whose appointment has
not been heretofore revoked or superseded.

SEC. 3. And be it enacted, That before proceeding
to execute any of the duties imposed, by the act of

which this is amendatory, each commissioner appoint-
ed as aforesaid, shall in addition to the oath or affirma-
tion required by the third section of said act, cause to
be prepared an official seal, a distinct impression of
which taken upon wax, or some other substance capa-
ble of receiving and retaining a clear impression, together
with his signature in his own proper hand writing
thereto attached, shall with the affidavit aforesaid, be
transmitted to, and filed in the office of the Secretary of State.

SEC. 4. And be it enacted, That it shall be the
duty of the Secretary of State, immediately upon the
receipt of the evidence of qualification, provided for in
